US Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer human smuggling charges, he was detained in federal detention.
In her order, the judge noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
